Terms of Service

1. Acceptance of Terms

By accessing or using FormPapi, including creating an account, building forms, collecting submissions, or otherwise interacting with our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, “you” and “your” refer to that organization.

2. Description of Service

FormPapi is an AI-powered form builder platform that enables users to create, publish, share, and analyze interactive forms, surveys, quizzes, and data collection experiences. The Service includes, but is not limited to:

• A visual form builder with drag-and-drop functionality, freeform canvas mode, and over 30 supported field types
• AI-assisted form generation and content suggestions powered by large language models
• Non-destructive, versioned form editing that preserves all prior submissions and their associated schemas
• Logic branching, scoring, conditional routing, and outcome-based workflows
• Response collection, analytics, and data visualization dashboards
• Integrations with third-party services via webhooks, native connectors, and a RESTful API
• Embedding, custom domains, and sharing capabilities

We reserve the right to modify, enhance, or discontinue any feature of the Service at any time, with or without notice.

3. Account Registration

To access most features of FormPapi, you must create an account. When registering, you agree to the following:

• Age requirement: You must be at least 18 years of age to create an account and use the Service. By registering, you represent that you are at least 18 years old.
• Accurate information: You agree to provide truthful, accurate, and complete registration information, and to keep that information up to date.
• Account security: You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must immediately notify us at hello@formpapi.com if you suspect any unauthorized access to your account.
• One person per account: Accounts are for individual use. Sharing login credentials with others is prohibited. Teams should use the workspace collaboration features provided by the Service.

4. Acceptable Use

You agree to use FormPapi only for lawful purposes and in compliance with all applicable laws and regulations. You must not:

• Use the Service to send spam, unsolicited bulk communications, or phishing content
• Create forms that collect sensitive information (e.g., payment card numbers, Social Security numbers) without appropriate security measures and legal compliance
• Upload, distribute, or collect illegal, defamatory, harassing, threatening, abusive, or otherwise objectionable content
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any systems or networks connected to the Service
• Use automated tools, bots, scrapers, or other means to access, extract, or manipulate data from the Service without our express written permission
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
• Interfere with or disrupt the integrity or performance of the Service, including by transmitting malware, viruses, or harmful code
• Resell, sublicense, or redistribute the Service or any part thereof without written authorization

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

5. Intellectual Property

Our property: The FormPapi platform, including its source code, design, logos, trademarks, documentation, and all associated intellectual property, is and remains the exclusive property of The Pipsail Corporation. These Terms do not grant you any right, title, or interest in or to the Service except for the limited right to use it in accordance with these Terms.

Your content: You retain full ownership of all forms, questions, content, designs, media, and data that you create, upload, or collect through the Service (“User Content”). By using the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, and display your User Content solely for the purpose of providing and improving the Service.

Respondent data: You own the submissions and responses collected through your forms. We process this data on your behalf as a data processor in accordance with our Privacy Policy.

6. Data and Privacy

Your privacy is important to us. Our collection, use, and handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

You are responsible for ensuring that your use of the Service to collect data from respondents complies with all applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and any other relevant legislation in your jurisdiction. You must provide appropriate privacy notices to your form respondents and obtain any necessary consents.

7. Subscription and Payments

FormPapi offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis, as selected at the time of purchase.

• Payment processing: All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us (via Stripe) to charge the payment method on file for the applicable fees.
• Auto-renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will be charged the then-current rate for your plan at the time of renewal.
• Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No prorated refunds are issued for partial billing periods.
• Price changes: We may adjust subscription pricing from time to time. We will provide at least 30 days' advance notice before any price increase takes effect on your account.
• Taxes: Prices are exclusive of applicable taxes unless otherwise stated. You are responsible for any taxes, duties, or fees imposed by your jurisdiction.

8. Free Tier

FormPapi offers a free tier that includes the following:

• Unlimited form creation
• Up to 50 submissions per month across all forms
• Access to basic field types and analytics (including drop-off analysis)
• One workspace user
• FormPapi branding displayed on published forms

The free tier is subject to fair use. We reserve the right to modify free tier features, limits, or availability at any time. Abuse of the free tier (e.g., creating multiple accounts to circumvent limits) may result in account suspension.

9. API Usage

FormPapi provides a RESTful API for programmatic access to the Service. Use of the API is subject to the following conditions:

• Rate limits: API requests are subject to rate limiting. Current rate limits are documented in our API documentation. Exceeding rate limits may result in temporary throttling or suspension of API access.
• Fair use: You must use the API in a manner consistent with the intended functionality of the Service. Excessive or abusive API usage that degrades the experience for other users is prohibited.
• API keys: You are responsible for safeguarding your API keys. Do not share them publicly or embed them in client-side code. Compromised keys should be revoked and regenerated immediately.
• Attribution: If you build applications or integrations using the FormPapi API, you agree to comply with our branding guidelines where applicable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PIPSAIL CORPORATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Termination

You may terminate your account at any time by contacting us at hello@formpapi.com or through your account settings.

We reserve the right to suspend or terminate your account and access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive conduct, or for any other reason at our sole discretion. Upon termination:

• Your right to access and use the Service will immediately cease.
• We may, but are not obligated to, retain your data for a reasonable period to allow you to export it, unless retention is required by law.
• All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

• Provide at least 30 days' advance notice via email or a prominent notice within the Service
• Update the “Last updated” date at the top of this page
• Post the revised Terms on our website

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and close your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection on the grounds of inconvenient forum.
